FTS provides, depending on plan or agreement:

• White-label SaaS access

• Messaging and workflow automation

• Technical setup, support, and consulting

Specific features, limits, and pricing are defined in proposals, plans, or written agreements.

3. White-Label SaaS Platform

FTS provides access to a white-label CRM and automation platform powered by third-party infrastructure, including GoHighLevel.

You acknowledge that:

• The platform is branded and administered by FTS

• The underlying software and hosting are provided by third-party providers

• Each client operates within a separate sub-account

• You retain ownership of all data stored in your account

FTS does not guarantee uninterrupted or error-free service availability.

4. Account Registration & Security

You agree to:

• Provide accurate and current information

• Keep login credentials confidential

• Be responsible for all activity under your account

FTS is not liable for unauthorised access caused by your failure to secure credentials.

5. Data Protection & Roles

For GDPR purposes:

• You are the Data Controller of all data in your SaaS account

• FTS is the Data Processor for platform operation and support

• FTS is a Data Controller for its own website, billing, and administration

Data processing is governed by our Privacy Policy and, where applicable, a Data Processing Agreement (DPA).

6. Client Compliance Obligations

You are solely responsible for:

• Lawful collection of contact data

• Obtaining valid consent for email, SMS, WhatsApp, and voice

• Compliance with GDPR, ePrivacy, telecom, and marketing laws

• Managing opt-ins, opt-outs, and unsubscribe requests

FTS does not verify consent and acts only on your instructions.

Acceptable Use Policy (AUP)

You may not use FTS services to:

• Send spam or unsolicited communications

• Use purchased, scraped, or third-party contact lists

• Violate privacy, marketing, or telecom regulations

• Impersonate individuals or organisations

• Transmit malware, harmful code, or abusive content

• Engage in fraudulent, misleading, or illegal activity

Enforcement

FTS may, at its sole discretion:

• Suspend or restrict access

• Disable messaging channels

• Terminate accounts without refund

• Cooperate with regulators or providers

This is essential to maintain compliance with telecom and platform partners.

7. Third-Party Services

Our services integrate with third-party providers including:

• Hosting and infrastructure

• Messaging and telecom providers

• Analytics platforms

• Payment processors

FTS is not responsible for:

• Third-party outages or downtime

• Policy changes by external providers

• Suspensions caused by your activity

Use of third-party services is subject to their own terms.

8. Fees, Billing & Payments

Unless otherwise stated:

• Fees are billed in advance

• Payments are non-refundable

• Late or failed payments may result in suspension

You are responsible for all applicable taxes unless explicitly stated otherwise.

9. Intellectual Property

FTS retains all rights to:

• The For The Stars brand

• Website content

• Templates, documentation, and system architecture

You retain ownership of:

• Your data

• Your content

• Your customer records

No rights are granted except as expressly stated.

10. Service Availability

FTS does not guarantee:

• Continuous uptime

• Error-free operation

• Compatibility with all systems

Maintenance, updates, or outages may occur without notice.

11. Termination

FTS may suspend or terminate access for:

• Breach of these Terms

• AUP violations

• Non-payment

• Illegal or abusive activity

Upon termination:

• Access may be revoked immediately

• Data may be deleted after a reasonable retention period

12. Limitation of Liability

To the maximum extent permitted by law:

• FTS is not liable for indirect or consequential damages

• Total liability is limited to fees paid in the previous 12 months

Nothing limits liability for fraud or mandatory legal obligations.

13. Indemnification

You agree to indemnify and hold harmless FTS from claims arising from:

• Your use of the services

• Your data or communications

• Your legal or regulatory violations

b) Resellers & White-Label Clients

If you resell or provide access to the platform:

• You are responsible for your end-users

• You must enforce these Terms with them

• You remain liable for their actions

FTS has no direct relationship with your end-clients.

c) Snapshots & Templates

Snapshots, workflows, and templates provided by FTS:

• Are licensed, not sold

• May not be redistributed or resold without written consent

• May be modified or withdrawn at any time

14. Changes to These Terms

FTS may update these Terms at any time. Continued use constitutes acceptance of the revised Terms.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Estonia.

Disputes are subject to the exclusive jurisdiction of the Estonian courts, unless mandatory law requires otherwise.
